Zoning Board of Adjustment

Members

The Board of Adjustment is a five regular member board with one alternate for a two year term.

About the Board

  1. The Board of Adjustment shall be authorized, in appropriate cases and subject to appropriate conditions and safeguards, to make special exceptions to the terms of Chapter 157, and any subsequent zoning ordinances, that are consistent with the general purpose and intent of Chapter 157, and any subsequent zoning ordinances, and in accordance with any applicable rules contained in Chapter 157, and any subsequent zoning ordinances.
  2. The Board of Adjustment may hear and decide an appeal that alleges error in a final order, requirement, decision, or determination made by a City Code Compliance Officer in the enforcement of any zoning ordinance; hear and decide special exceptions to the terms of Chapter 157, and any subsequent zoning ordinances, as permitted; authorize in specific cases a variance from the terms of Chapter 157, any subsequent zoning ordinances, if the variance is not contrary to the public interest and, due to special conditions, a literal enforcement of Chapter 157, and any subsequent zoning ordinances, would result in unnecessary hardship, and so that the spirit of the city’s zoning ordinances are observed and substantial justice is done; and hear and decide matters authorized by a zoning ordinance of the city.
  3. The following persons may appeal to the Board of Adjustment a final decision made by a City Code Compliance Officer: a person aggrieved by the decision; or any officer, department, board or bureau of the city affected by the decision.
